This summary is here to help you read the terms. It is not a substitute for the full text below.

• BinderPlug helps you discover and coordinate local card trades. The trades themselves happen in person, between you and another trader, outside the app. We are not a party to them.
• BinderPlug is for adults only. You must be 18 years of age or older to create or hold an account.
• We provide discovery, coordination, report, and feedback tools. We do not guarantee identity, safety, card value, fraud absence, matches, meetups, trades, mediation, compensation, or any specific outcome.
• You are responsible for your trades: checking cards, judging value, choosing where and when to meet, and deciding who you trade with.
• Be honest and respectful. Scams, harassment, and misuse may result in suspension or a ban.
• Deleting your account permanently deactivates it and overwrites its identifying details; completed trade and feedback records remain as "Deleted User" so other traders' history stays intact.
• BinderPlug is in early release: it is under active development, features may change, and it may contain defects.
• Most claims relating to BinderPlug must be brought within one year of when you knew or should have known about them (Section 16), where the law allows that period.
• These terms use a version number. If they change in a way that materially affects you, we will notify you before the new version applies.

1. Agreement

These Terms of Service are an agreement between you and Wyrdbit LLC, a California limited liability company, covering your use of the BinderPlug mobile app and the binderplug.app website (together, "BinderPlug").

You accept these terms when you create an account. The registration screen presents a versioned registration notice that names the Terms of Service and Privacy Policy versions it covers and asks you to confirm that you have reviewed and accept them. If your phone's app store cannot confirm that its account is 18 or older, the screen also asks you to confirm the age attestation described in Section 2. We record the notice version you accepted, and any attestation version you confirmed, each with a server-recorded time. If you do not agree to these terms, do not create an account or use BinderPlug.

Our Privacy Policy explains what data we handle; read it together with these terms.

2. Eligibility and accounts

• BinderPlug accounts are for adults 18 years of age or older. Create an account only for yourself. Do not create or hold an account for someone under 18.
• By creating or holding an account, you represent and warrant that you are 18 years of age or older and that the account is for you alone.
• You also represent that you reside in the United States, that you have the legal capacity to enter this agreement, and that no applicable law prohibits you from using BinderPlug.
• When you create an account, and when you sign in, the app asks your phone's app store (Apple or Google) whether the account on the phone belongs to someone 18 or older. Where the store cannot answer, creating an account instead asks for your birth month and year, which stay on your phone, and asks you to confirm the statement "I am 18 years of age or older"; we record the version of the attestation you confirmed and the time you confirmed it. The store's answer describes the account on the phone: we do not verify anyone's identity or actual age. Our Privacy Policy (Section 9) describes the check.
• If the app store reports an age under 18 when someone signs in to an existing account, we may place the account on hold while a person reviews it, as our Privacy Policy (Section 9) describes.
• If we find that an account is held by, or was created for, a person under 18, we will terminate it and apply the account-deletion treatment described in our Privacy Policy (Section 7), and the account's email address cannot be used to register again for one year, unless we lift that block earlier (Privacy Policy, Section 9).
• Provide accurate account information and keep your password to yourself. You are responsible for activity that happens through your account. Tell us promptly at [email protected] if you believe your account has been compromised.
• Display names must not impersonate others or contain slurs, harassment, or advertising. Names are screened by an automated filter at registration; a violating name may lead to suspension or termination under Section 9, and we may rename an account whose name breaks these rules.
• Display names are permanent. They anchor your reputation with other traders, so there is no name-change feature and we do not change names on request; we may change a name where the law requires it.
• Display names must be unique; we may reject a name that is taken or too similar to an existing one.
• We may use device integrity checks (Apple App Attest, Google Play Integrity) and other anti-abuse controls to limit automated or duplicate registration.

Geographic availability. BinderPlug is offered only to users located in the United States. We make no representation that the Service is available or appropriate elsewhere.

3. What BinderPlug is and is not

BinderPlug helps collectors discover possible local card trades by comparing the cards you want with the cards other people are willing to trade, and by showing you other traders near you. It provides tools for coordinating a meetup, exchanging structured trade proposals, leaving feedback, and reporting problems.

BinderPlug is not a party to any trade, agreement, or meetup between users. Trades are agreements between the traders only. We are not a broker, agent, appraiser, escrow service, or guarantor for any trade: we never handle, verify, or guarantee the exchange itself, and we cannot reverse, refund, or compensate for one. The app does keep its own records current after a meetup (closing out trades neither side has updated and adjusting the card lists they involve), but that is bookkeeping, not supervision.

BinderPlug provides discovery, coordination, report, and feedback tools. It does not guarantee identity, safety, card value, fraud absence, matches, meetups, trades, mediation, compensation, or any specific outcome. In particular:

WE DO NOT VERIFY USERS OR RUN BACKGROUND CHECKS

We do not verify who other users are, and we do not run background checks of any kind.

• We do not inspect, grade, or authenticate cards, and we are not an appraiser. The app may show an indication of relative trade value, derived by comparing third-party market data for the cards on each side; it is informational only, may be wrong or out of date, is not a guarantee of value or fairness, and does not replace your own judgment.
• Meetup places are public places listed in the app for local meetup planning only; you and the other trader choose where to meet. We do not verify, endorse, or guarantee the safety of any place. We build the list from open map data and public web pages, mostly the places' own websites (credits at binderplug.app/legal/licenses), and it may be incomplete or out of date. Listed places and their operators are independent third parties, not our partners, agents, or representatives. Details and conditions at a place may be inaccurate or may change; we do not inspect or monitor any place, confirm that it is open or suitable, or make any promise about its lighting, surveillance, traffic, accessibility, security, or condition. Details we show about a place, such as seating or a police station's exchange area, repeat what the place or its operator publishes and are not our assessment. We may update the list, and we may act on a report that a place has closed or changed, but we do not check places in person. You alone decide whether to use a place.
• Reputation levels, feedback scores, and trust indicators summarize other users' reported experience. They are not a guarantee of anyone's conduct.
• We do not mediate disputes, reimburse losses, or provide compensation.

BinderPlug links to and uses third-party services: for example maps and directions, card catalog data and images, and app-store services. We do not control them, we are not responsible for their content or availability, and their own terms and privacy policies apply when you use them.

4. Local trades are your responsibility

Trades arranged through BinderPlug happen in person, outside the app. Card condition, card value decisions, user conduct, and meetup choices remain solely the responsibility of the traders. Use common sense: meet in public places, bring someone with you when it makes sense, inspect cards before trading, and walk away from any trade that feels wrong. We publish practical suggestions for meeting other traders in person at binderplug.app/safety; they are suggestions, not guarantees, and they are not part of these terms.

YOU CHOOSE WHERE, WHEN, AND WITH WHOM YOU TRADE

You alone decide whether, where, when, and with whom to trade, and you assume the risks of meeting and trading with other people in person, including the risk of fraud, theft, robbery, bodily injury, death, and loss of or damage to your property caused by other users, by third parties, or by conditions at a meetup location.

YOU RELEASE US FROM DISPUTES WITH OTHER USERS

To the fullest extent permitted by law, you release Wyrdbit LLC and the Wyrdbit parties defined in Section 14 from claims, demands, and damages of every kind arising out of or connected with disputes between you and other users, including trades, meetups, and anything that happens at them.

You also waive California Civil Code Section 1542, and any similar law of any other state or jurisdiction. Section 1542 says: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party."

Nothing in this section limits or excludes any liability that cannot lawfully be limited or excluded (Section 14).

5. Your content

You keep ownership of the content you add to BinderPlug: your card lists, display name, feedback ratings, and reports. You give Wyrdbit a non-exclusive, worldwide, royalty-free license to host, store, display, and share that content as needed to operate BinderPlug: for example, showing your Offer Binder to nearby traders, showing other traders reputation signals derived from your feedback (individual feedback appears within the relevant trade), or showing your display name and the cards in your shared binder to anyone who opens a Share Binder link you generated, in the app or as a preview page in a web browser. Running the service also means we may copy, resize, reformat, transmit, and back up your content where that is needed to display it, deliver it, or preserve it. We do not use your content for advertising and we do not use it to train AI models. This license ends when the content is deleted, except for the records retained after deletion as described in Section 10.

You are responsible for what you post. You promise that the content you add is yours to add and does not infringe anyone's rights or break any law. Feedback and reports must reflect your honest experience of a real interaction.

Suggestions. If you send us ideas, suggestions, or feature requests (which is not the same thing as the trade feedback described in Section 7), they are not confidential, and you give us a perpetual, irrevocable, royalty-free right to use them without compensation or credit.

6. Acceptable use

Do not:

• scam, defraud, or attempt to defraud other users, including misrepresenting a card's identity, condition, or authenticity;
• harass, threaten, or abuse other users, in the app or at meetups;
• impersonate another person or misrepresent who you are, including your age;
• use BinderPlug to trade or sell counterfeit or stolen cards or anything illegal;
• create accounts by automated means, evade a suspension or ban (including by re-registering), or circumvent rate limits, device checks, or other technical protections;
• scrape, harvest, or bulk-collect other users' data;
• probe, disrupt, or overload our systems, or access data that is not yours (report vulnerabilities to [email protected] instead);
• use the app to advertise unrelated products or services;
• leave feedback or file reports in bad faith.

We have zero tolerance for objectionable content and abusive behavior: accounts engaging in abuse, harassment, or scams may be suspended or banned.

We may investigate violations and take action described in Section 9.

7. Feedback, reports, and moderation

After a trade, you and your partner can each leave feedback, for a limited time after the scheduled meetup. Feedback cannot be changed once you submit it. Negative feedback from your partner does not stop you from leaving your own within that time. Once the time has passed, or after a trade has been closed out automatically, leaving feedback may no longer be possible. Feedback affects reputation signals other users see.

Any signed-in user can report any other user, subject to reasonable limits; you do not need to have traded with them. Reports use fixed categories (for example unsafe behavior, no-shows, harassment, and scam attempts) and have no free-text field. Reports go to us, not to other users, and help us triage problems. We review reports and may act on them, but we do not commit to investigate any particular report or to any particular response, timeline, or outcome, and we do not mediate between traders or provide compensation.

A report to BinderPlug is not a 911 call. If someone is in danger or a crime is happening, contact emergency services directly. We may report conduct to law enforcement, and we may comply with legal process; our Privacy Policy (Section 6) describes those disclosures.

We have no obligation to monitor, screen, or review user content, accounts, or conduct, and we do not endorse any user, card list, or content. We may do any of those things at our discretion (including investigating reports, reviewing accounts, and removing content) without taking on a duty to do so in any case.

Blocking tools limit contact between accounts inside the app; they cannot control what happens outside it. Blocking someone also cancels any trades between the two of you that haven't happened yet; a trade whose meetup time has already passed stays open so each of you can leave feedback. We do not tell the other person that they were blocked.

8. Intellectual property

BinderPlug, the BinderPlug name and logo, and the app's design and software are the property of Wyrdbit LLC. These terms do not give you any right to use our branding.

Subject to these terms, we give you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use one copy of the BinderPlug app on a device you own or control, for your own personal use of BinderPlug. That license ends if your account ends. This license does not apply to the iOS app, which is licensed as described in Section 17.

BinderPlug is a fan-community tool and is not affiliated with, endorsed by, or sponsored by the publishers of any trading card game. Magic: The Gathering and its card names are trademarks and copyrights of Wizards of the Coast. Card catalog and price data are provided through public databases (Scryfall and MTGJSON for Magic; TCGdex for Pokémon). All card names, images, and related marks remain the property of their respective owners and are used for identification only. Attribution and license notices for these sources are listed at https://binderplug.app/legal/licenses.

8.1 Copyright complaints

If you believe content on BinderPlug infringes your copyright, send a notice to [email protected], or to Wyrdbit LLC, Attn: Copyright Agent, 31441 Santa Margarita Pkwy, Ste A #8099, Rancho Santa Margarita, CA 92688, USA. Include: identification of the copyrighted work; identification of the material you say infringes it and where it appears in BinderPlug; your contact details; a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law; a statement, under penalty of perjury, that the notice is accurate and that you are the owner or authorized to act for the owner; and your signature.

We remove or disable material we determine to be infringing, and our policy provides for terminating the accounts of repeat infringers in appropriate circumstances.

If your content was removed by mistake or misidentification, you may send a counter-notification to the same addresses. It must include: identification of the removed material and where it appeared before removal; your name, address, telephone number, and email address; a statement, under penalty of perjury, that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification; a statement that you consent to the jurisdiction of the federal district court for the district where your address is located (or, if outside the United States, the Central District of California) and that you will accept service of process from the person who filed the original notice or their agent; and your physical or electronic signature.

9. Suspension and termination

We may suspend or terminate your account, remove content, or cancel pending trades if we reasonably believe you have violated these terms, put other users at risk, or abused our systems, with or without notice, depending on severity. Where practical we will tell you what happened. We may also refuse or revoke access where required by law. We will terminate an account we find is held by, or was created for, a person under 18, and apply the account-deletion treatment described in our Privacy Policy (Section 7).

If we suspend or terminate your account or remove your content and you believe the decision was a mistake, you can ask us for one review: email [email protected] from the account's email address and explain why. Asking for a review does not restore access or pause enforcement while we look. We may keep back detail that would identify a reporter, expose an investigation, or reveal how our anti-abuse controls work. We do not promise a response time or any particular outcome.

Banned users may not create new accounts. We use limited technical signals to enforce this, and deleting a banned account does not lift the ban.

You can stop using BinderPlug at any time; to deactivate your account and have your data handled as Section 10 describes, use account deletion.

10. Account deletion

You can delete your account in the app: Settings → Delete Account, with password confirmation. Deletion in the app happens right away.

You can also ask us to delete your account without signing in, from the account-deletion page at binderplug.app/account/delete: enter the account's email address, and we act only after you confirm a single-use verification link sent to that address. We then email that address the time after which the account will be deleted, at least 24 hours later, with a link to cancel; after that time the deletion is carried out unless you cancel.

Deletion deactivates your account permanently and deletes or overwrites its data: profile, contact, location, push, and avatar data are overwritten or cleared; card-list entries are deleted, except cards that are part of a trade, which are kept hidden for that trade's record; sign-in sessions are revoked; Share Binder links and saved-trader entries are deleted; in-progress trades are cancelled, and we attempt to notify your trade partners. Completed trade records, feedback ratings, and report records are retained as "Deleted User", linked internally to the deactivated and pseudonymized account, to keep other users' history accurate and to prevent abuse. Deletion is not reversible. The Privacy Policy (Section 7) describes retention in detail.

To limit abuse, the same email address cannot be used to register a new account for 30 days after deletion. Longer limits apply where we delete an account because its holder is under 18 (one year, Section 2) or where the account was permanently banned (Section 9).

11. Fees and future subscriptions

BinderPlug is currently free to use. We may introduce optional paid features or subscriptions in the future. If we do: pricing, billing terms, renewal, and cancellation and refund terms will be presented before you pay and added to these terms through the update process in Section 12; purchases made through the Apple App Store or Google Play will be billed and refunded under that store's rules; and features that are free today may become paid only prospectively. We will not bill you for anything without your explicit enrollment.

12. Changes to BinderPlug and to these terms

BinderPlug is in early release. It is under active development and may contain defects, and features may change, be added, or be removed. We may change, suspend, or discontinue some or all of BinderPlug at any time, and we are not liable to you for doing so; where a change materially affects you, the notice process below applies, and nothing in this paragraph overrides the account-deletion and data-handling commitments in Section 10 and the Privacy Policy.

These terms are versioned; from their effective date, each change is recorded here. If we make a material change, we will announce it at least 30 days before it takes effect (at least 60 days for a change that materially reduces your rights, materially expands our use of data, or changes dispute-resolution, liability, or fee terms) by email to your account address. A change required by law, or needed urgently for security or safety, may take effect sooner, but shorter notice never shortens consent: a change that materially expands our use of your data applies to your data only after you accept it. That consent step is a blocking screen in the app: it asks you to review and accept the new version before you keep using your account, and it records your acceptance. We keep a dated record of each version and its announcement. Changes that are not material, for example clarifications, contact-detail updates, or new features that do not reduce your rights, take effect on posting with an updated version identifier. Your account records the registration-notice version you accepted at account creation (the notice names the Terms version it covers), any later version you accept in the app, and the server time of each acceptance.

13. Disclaimers

BINDERPLUG IS PROVIDED "AS IS"

BinderPlug is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the app will be uninterrupted, error-free, or secure, that matches will be found, that meetups will occur, or that any trade will go well. Some jurisdictions do not allow certain warranty disclaimers, so parts of this section may not apply to you.

14. Limitation of liability

These terms are between you and Wyrdbit LLC only. To the maximum extent permitted by law, Wyrdbit LLC and its members, managers, owners, employees, contractors, and agents, and their respective affiliates, successors, and assigns (together, the "Wyrdbit parties") will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost cards, lost value, lost profits, or personal injury or property damage arising from trades or meetups arranged through BinderPlug, even if we have been told such damages are possible.

OUR TOTAL LIABILITY IS LIMITED TO USD 100

To the maximum extent permitted by law, the Wyrdbit parties' total combined liability for all claims relating to BinderPlug is limited to one hundred U.S. dollars (USD 100) or the amount you have paid us in the past twelve months, whichever is greater.

You agree that any claim relating to BinderPlug must be brought against Wyrdbit LLC and not against any member, manager, or employee personally. Some jurisdictions do not allow certain liability limits, so parts of this section may not apply to you.

The limitations in this section and in Section 13 are an essential basis of the bargain between you and Wyrdbit: BinderPlug is currently offered free of charge (Section 11), and it would not be offered on these terms without them. They apply even if a limited remedy fails of its essential purpose. If a court finds any part of this section unenforceable as written, that part is to be enforced to the maximum extent the law allows, and the rest of the section stays in effect.

Nothing in these terms limits or excludes liability for fraud, fraudulent misrepresentation, willful injury, gross negligence, or anything else that cannot lawfully be limited or excluded, including under California Civil Code Section 1668.

15. Indemnity

If someone other than you brings a claim against Wyrdbit because of your violation of these terms, your content, or your conduct in a trade or meetup, you agree to indemnify Wyrdbit against the resulting losses, costs, and reasonable legal fees, to the extent permitted by law.

This works as follows: we will notify you promptly in writing of any claim covered by this section; a delay in our notice reduces your obligation only to the extent the delay actually prejudices you. We control the defense of the claim and the choice of counsel; you agree to cooperate reasonably with the defense. Neither side may settle a covered claim in a way that admits fault on the other's behalf or imposes any obligation on the other without that side's prior written consent, which may not be unreasonably withheld.

16. Governing law and disputes

These terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Orange County, California, and both sides consent to that venue.

Before filing a claim, the person bringing it must send a written notice to [email protected] (or to our mailing address) identifying the account, the facts, the legal basis, and what they want, and both sides will try in good faith to resolve it for 30 days after the notice arrives. This is a condition of filing. It does not apply to a qualifying small-claims action, or where someone needs urgent relief from a court to prevent harm that cannot wait, and it does not waive rights that cannot be waived.

Time to bring claims. Any claim relating to BinderPlug or these terms must be filed within one year after the party bringing it knew, or reasonably should have known, of the facts giving rise to it, or it is permanently barred. That period is paused while the notice process above is running. This paragraph does not shorten any limitations period that applicable law does not permit to be shortened.

If the law of the place where you live gives you mandatory consumer rights, nothing in these terms takes those rights away, and nothing in this section prevents you from bringing a claim in your local courts where that law guarantees it.

17. App store terms

You may also be bound by the terms of the store you installed BinderPlug from. Apple and Google are not parties to these terms and are not responsible for BinderPlug or its content.

iOS. If you installed BinderPlug from the Apple App Store, the app is licensed to you under Apple's standard Licensed Application End User License Agreement (published by Apple), which controls within its own scope; these terms supplement it and govern your BinderPlug account and the service.

Android. If you installed BinderPlug from Google Play, the app license in Section 8 applies, alongside Google Play's own terms. Where a store's own rules conflict with these terms for your installation, that store's rules control.

18. General

If part of these terms is found unenforceable, that part is to be enforced to the maximum extent the law allows, and the rest still applies. Our not enforcing a provision is not a waiver. You may not transfer your account or these terms to someone else; we may assign these terms as part of a reorganization or sale of Wyrdbit LLC. Sections 3, 4, 5 (the Suggestions grant in full, and the content license to the extent it covers records retained under Section 10), 8, 10, and 13 through 16 survive account deletion or termination. These terms, together with the Privacy Policy and the registration notice you accepted, are the entire agreement between you and Wyrdbit about BinderPlug. Nothing in these terms creates a partnership, employment, or agency relationship between you and Wyrdbit or between you and any other user.

Electronic communications. You agree that we may give you notices, disclosures, and agreements electronically (by email to your account address or in the app) and that these satisfy any requirement that they be in writing. Keep your account email current.

Events outside our control. We are not liable for failing to provide BinderPlug because of something outside our reasonable control, including network or hosting failures, acts of nature, labor disputes, war, civil unrest, or government action.

Export and sanctions. You confirm that you are not located in a country subject to a U.S. embargo and are not on any U.S. restricted-party list, and you agree not to use BinderPlug in violation of U.S. export or sanctions law.
